ive convinced myself its ok, bc nintendo shut down the eshop, meaning they have WILLINGLY shut down their cash flow from the wii u and 3ds, so since the main company isnt getting any money for it, it doesnt rlly matter where you get the games

Nintendo doesn't really care if we mod our 3ds's anyway. They only sue when something "infringes" on their copyright, which when a fangame or project gets too popular, they hit the C&D's.
