Did you try downloading a .cia update file and installing it with FBI?
try updating through hshop
ive tried to update with hshop before and it doesnt work, it gives an error

Try switching to Nintendo servers, (Ensure Sending of Information in Internet Settings is OFF), and try updating it straight from the Plaza.
Sorry, I meant "Sending of Usage Information". You need to make sure it's off, or Nintendo will know you're hacking.
