dumped M&L:PiT from wii u, moved it to 3DS, and it works perfectly. I dont understand why we couldnt download ds games on 3ds, but yes on wii u

you could download dsiware, dunno why they never released ds games. maybe storage space?
i dont think it was storage space, since you could buy digital 3ds games between 250mb-4gb, and my ds games are 16mb-250mb
they did do one, warioware touched. only as a my nintendo reward though
