yes, but no. they won't bother with a 3ds
care to explain because i think they tried to brick them before with one of the last updates.
Honestly the new EULA is very oddly worded, some theorize that updates to like the Switch 2 for instance would pose the risk of bricking it; no one knows if they will actually be able to like, remotely brick a system. A 3DS is probably okay though.
As far as I know it's if you run unsigned code (yar har'd games) on the Switch while having it connected to the internet.
