SpotPass only connects to Pretendo because all of the Nintendo Network servers are down. (i.e. there's nothing to connect to.) The only thing Nintendo Network is used for anymore on the 3DS is redownloading eShop software, verifying Pokémon Bank, and a couple of other things.
