Answering as Japanese player. Jailbreaking a console is legal as long as it is for personal use (meaning you don't make money from it). I'm not goot at English, so I appologize if there are any mistakes in my writing.
Based on the comment above, I think it's legal, Nintendo just can do more about it since it's in their home country/territory
